As a user of the SAAS (Software as a Service) Provider, you agree that all costs and responsibility for compliance with the Do Not Call list, along with all appropriate disclosure and reporting rules and requirements are borne solely by you as User. Any violation of the Do Not Call or other Federal, State, or Local regulation, law, or ordinance during the use of this software shall be cause for immediate termination of your account. Further, as User, you agree to indemnify and hold harmless Victory Phones, its employees, owner(s), and contractors, from from all liability, damages, or loss from or arising out of the use of Victory Phones by the Client and/or the Client's agents or employees, whether negligent or otherwise. Additionally, you agree to indemnify and hold harmless Victory Phones, its employees, owner(s), and contractors from all claim(s) or legal violation(s) arising out of your use of this software service, whether Federal, State, or Local in nature. This duty to indemnify, defend, and hold harmless shall include all costs of litigation or defense of claims including attorney fees, costs, and expert fees.
